Terms of Use

Through www.beycome.com ("Website"), beycome Corp., Beycome Brokerage Realty LLC, Beycome of Florida LLC, Beycome Brokerage Realty Inc. (collectively, "beycome", "we", "us", or "our") provide an online service for homeowners to list their residential real estate on the Website and, if selected by the homeowner, through the applicable real estate multiple listing service ("MLS"), and prospective buyers and tenants to find and purchase or lease, respectively, such real estate (collectively, the "Service"). Beycome Brokerage Realty LLC, Beycome of Florida LLC, Beycome Brokerage Realty Inc. are the licensed real estate brokers for transactions consummated through the Website, which is owned by Beycome Corp.

Please read the following beycome™ Terms of Use ("Terms") that contain important information about your legal rights, obligations, and remedies as they pertain to your access to and use of the Service. By accessing or using the Service, you agree to comply with and be bound by these Terms, our Privacy Policy (which is hereby incorporated into these Terms by reference) and, as applicable, our Exclusive Buyer/Renter Brokerage Agreement ("Buyer Agreement"), and, if an Owner elects to have beycome list their Property on the MLS Service, then our Listing Agreement, Disclosures & Disclaimers ("Listing Agreement").

These Terms are a binding agreement between you ("you" or "your") and beycome ("beycome"). For purposes of clarity, references to "you" in these Terms apply to any and all users or visitors to the Website and/or Service. You and beycome are the only parties to these Terms and may be referred to in the singular as a "Party" or in the plural as "Parties". These Terms govern your access to and use of the Website and Service.

beycome may, at its own discretion, and without advance notice, modify these Terms, or change, suspend, discontinue, impose limits or restrict access to any aspect of the Service at any time.

BY CLICKING THE "I AGREE" AND/OR "I CERTIFY" BUTTON, YOU ACKNOWLEDGE AND AGREE THAT (A) YOU HAVE READ AND UNDERSTAND THESE TERMS; (B) YOU ARE 18 YEARS OF AGE OR OLDER AND OF LEGAL AGE, AND ABLE TO ENTER INTO A LEGALLY BINDING CONTRACT; AND (C) YOU ACCEPT THESE TERMS AND AGREE TO BE LEGALLY BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THE SERVICE.

Minor Exclusion. The Service is intended solely for users who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old. beycome does not knowingly collect Personal Information from individuals under 18. If beycome discovers that a user is under 18, it will immediately terminate that user's account and delete any associated Personal Information. If you believe a minor has created an account or provided Personal Information through the Service, please contact us immediately at contact@beycome.com. Parents and guardians are responsible for monitoring their minor children's internet activity and ensuring they do not access or use the Service.

Definitions

  • Buyer — a person who uses the Service to find and purchase a Property.
  • Content — all materials, excluding Personal Information, including information, data, text, design elements, graphics, images, audio, video, and other content delivered via the Website.
  • Documentation — the documentation provided to Users electronically via the Website.
  • Intellectual Property Rights — all legally recognized forms of intellectual property and rights therein.
  • Owner — a person who uses the Service to list a Property for sale or rent.
  • Payment Service — any and all payment processing service used or provided by beycome's third party payment processor(s).
  • Personal Information — any information that does or can identify a specific individual.
  • Process — to perform any operation or set of operations on any data, information, material, work, expression or other Content.
  • Property — any residential real property listed and made available for purchase or rent through the Service.
  • Renter — a person who uses the Service to find and rent a Property.
  • Technological Safeguard — any code, device feature or functionality intentionally provided by beycome to monitor, detect, or prevent unauthorized access or use.
  • User — any and all visitors to the Website, including Buyers, Owners, and Renters.
  • User Data — any information or data, including Personal Information, which a User uploads, enters, or otherwise makes available through the Service.

Use of the Service

Limited License. Subject to and expressly conditioned on your compliance with these Terms, including timely payment of all amounts owed, beycome grants to you a personal, non-transferable, revocable, non-sublicensable, non-exclusive, worldwide right and license to (i) access and use the Service and the Website; and (ii) access and view the Documentation via the Website.

Laws, Rules and Regulations. You agree that you are responsible for, and will abide by, all laws, rules and regulations applicable to your access and use of the Service, including any transactions entered into through the Service.

Network Transmissions. You understand that the technical processing and transmission of the Website, your Content and your User Data may involve transmissions over various networks.

Communications. By using the Service, you agree to receive emails and text messages, whether from the Service or directly from beycome or another User, related to the listing, buying, or renting a Property.

BY USING THE SERVICE AND CLICK-ACCEPTING THESE TERMS, YOU HEREBY GIVE BEYCOME, AND ITS SERVICE PROVIDERS, EXPRESS CONSENT TO CONTACT YOU ON YOUR TELEPHONE, INCLUDING, BUT NOT LIMITED TO, LEAVING YOU VOICE MESSAGES AND SENDING YOU TEXT MESSAGES, AND TO SEND YOU E-MAILS, WITH NOTIFICATIONS, INFORMATION, AND OFFERS RELATED TO BEYCOME AND THE SERVICE.

SMS / Text Message Communications. By providing your mobile phone number and using the Service, you expressly consent to receive recurring automated text messages (SMS and MMS) from Beycome Corp. and its affiliates at the number you provided. These messages may include property alerts, appointment reminders, transaction updates, and promotional offers related to our real estate services.

  • Message Frequency: Message frequency varies based on your activity and preferences. You may receive up to 10 messages per month.
  • Opt-Out: You may opt out at any time by replying STOP to any text message. After opting out, you will receive one final confirmation message and no further SMS messages will be sent unless you re-enroll.
  • Help: Reply HELP for help or contact us at contact@beycome.com or call 804-656-5007.
  • Message and Data Rates: Message and data rates may apply depending on your mobile carrier and plan. Beycome is not responsible for any charges imposed by your carrier.
  • Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.
  • Consent Not Required: Consent to receive SMS messages is not a condition of purchasing any goods or services from Beycome. You may opt out at any time without affecting your access to our services.
  • Supported Carriers: Compatible with AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, U.S. Cellular, and most major U.S. carriers. Coverage may not be available in all areas.

Marketing Communications. From time to time, beycome may use your contact information — including your phone number and email address — to send you promotional materials, newsletters, and other information related to our services. By creating an account or interacting with our platform, you consent to receive such communications. beycome does not sell, rent, or share your Personal Information with third parties for their own marketing purposes.

  • Opt-Out by Email: Click the "Unsubscribe" link in any marketing email or contact us at unsubscribe@beycome.com.
  • Opt-Out by SMS: Reply STOP to any text message at any time.
  • Service Communications: Even after opting out of marketing, you may still receive non-promotional messages necessary for your account or active transactions.

User Data. You agree that, with respect to other Users' User Data that you obtain directly or indirectly from or through the Service, you may not use any such information for any unlawful purpose.

International Use. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct, Content, and User Data.

Account Registration and Security

Accounts and Passwords. In order to access and use certain functionalities of the Service, the User will be required to register for a User-specific account and password ("Account"). Each registered User will have a personal, non-transferable account and password that may not be shared or used by more than one person.

Account Security. You agree to (i) keep your password and user ID secure and strictly confidential, and (ii) notify us immediately if you believe your password may have become known to an unauthorized person.

Telephone Security. For security purposes, beycome will replace your personal telephone number by providing a free redirectional telephone number to protect your Personal Information and reduce the risk of potential scams.

Account Termination. beycome, in its sole discretion, may terminate your password, Accounts, and/or your right to use the Service at any time for any reason, including lack of use or failure to timely pay any fees.

Owner Content

Owner Grant of License. If you contribute, provide, or make available any Content through the Service ("Owner Content"), you hereby grant to us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right and license to use, reproduce, adapt, modify, distribute, translate, publish, create derivative works based on, perform, display, and otherwise exploit Owner Content.

Owner Representation and Warranty. You represent and warrant that you own or otherwise have all the rights, power, and authority necessary to grant the foregoing license.

Display of Content. Owners are responsible for reviewing and ensuring that any Content displayed on the Website appears as the Owner intended. Photographs should depict the actual Property as the main subject and may not include children or adults without their legal consent.

Owner Listings. You acknowledge and agree that if you submit a listing through the Service, you represent and warrant that (i) you own the property or are authorized to act on behalf of the Owner; and (ii) the listing is complete, accurate, and truthful.

Beycome Content

beycome Trademarks. The trademarks, service marks, and logos of beycome ("beycome Trademarks") used and displayed in connection with the Service are registered and unregistered trademarks or service marks of beycome. The Trademarks may not be used to disparage beycome or any third party.

Statements or claims. Any statements or claims made on this website regarding the potential financial benefits that a homeowner may achieve through utilizing our services are based on theoretical scenarios, algorithm estimates, and predictions. Homeowners and buyers should consult with their legal counsel to determine potential savings.

beycome Copyrights. All Content is the property of beycome or its Owners and protected by U.S. and international copyright laws. Except as expressly authorized by beycome, you agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on any beycome Copyrights.

Website Support and Security

Ancillary Facilities. In no event shall beycome have any obligation to provide, maintain or support any hardware, connectivity, third party software, communications services, bandwidth, and other goods necessary to access and use the Website.

Technological Safeguards. beycome shall have the right, but shall have no obligation, to use Technological Safeguards at any time to monitor access and use of the Website, detect or prevent unauthorized use, and protect Intellectual Property Rights.

Security and Other Risks. beycome shall exercise commercially reasonable due care to maintain the security of the Website. Your use of the Website necessarily entails risks, including security breaches, unavailability, and loss or corruption of data.

Service Modifications and Suspensions. We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Website at any time for any reason.

Additional Services

MLS Service. beycome allows you to list your Property on an MLS Service that notifies brokers and/or real estate agents who subscribe to the MLS Service that the Property is for sale or for rent.

Mortgage Payments Calculator. We provide Users with a mortgage calculator that estimates monthly mortgage payments based on certain criteria. The mortgage calculator is only meant to illustrate approximate mortgage payments.

Third-Party Services. Buyers may be provided with third-party links of real estate attorneys, title companies, surveyors, mortgage companies, trade professionals, moving companies and other service providers. beycome is not responsible or liable for the quality of any of the services rendered by the third-party providers.

Sample Legal Forms. beycome may provide sample legal forms for reference. These forms are not intended to be legal advice and should not be treated as such.

Photography Packages. beycome offers professional real estate photography services for purchase by Owners that include 24 high-definition images of the Property, taken as-is, by local photographers.

Broker Compensation is fully negotiable and is not fixed, controlled, recommended, or suggested by law or any multiple listing service or association of REALTORS®.

Buy with Beycome Service Fees — The Buyer Program

Buyer Service Fee & Compensation Agreement

Beycome, as your buyer agent, will seek to be paid a commission from the listing broker (seller's agent) or directly from the seller if there is no listing broker.

$1,399 flat fee paid upfront upon signing

Any commission offered by the seller at closing will be credited toward your closing costs or paid to you in cash, after deducting Beycome's $1,399 fee.

Following the National Association of REALTORS® settlement effective August 17, 2024:
  • Written Agreement Required: We must sign a written agreement detailing our compensation and responsibilities before showing any property.
  • Commission Disclosure: The buyer broker's commission is no longer disclosed on MLS listings. We will ask the listing broker or seller for compensation details after signing this agreement.
  • Buyer Concessions: You can still accept concessions from the seller, such as closing cost assistance.

Concierge Bundle Promo: If you are also enrolled in the Beycome Concierge listing package, your buyer program fee is reduced to $999 (instead of $1,399).

Possible Scenarios

Commission Exceeds $1,399 If the commission offered by the seller exceeds $1,399, the extra amount will be credited toward your closing costs or paid to you in cash.
Commission Equals $1,399 If the offered commission is exactly $1,399, our compensation will be covered by the seller, with no additional credit to you.
Commission Is Less Than $1,399 If the offered commission is less than $1,399, you will be responsible for paying the difference at closing.
Important Notes: Credits will comply with all applicable regulations, including those set by HUD, and will be applied towards your closing costs, prepaids, and other allowable expenses. The actual credit amount is subject to final lender approval and may vary based on the loan amount and terms.

Showings: Beycome covers the cost of the first five (5) showings. If more than five showings are needed, an additional fee of $44 per showing will be added at closing.

Credits subject to lender approval. This offer does not apply to properties listed without a commission.

Sell with Beycome Service — Flat Fee

Subject to and in accordance with an executed Listing Agreement, beycome charges Owner a one-time flat fee in accordance with the pricing listed on the Website for the Basic package ($99), Enhanced Package ($399) and Concierge Package ($1,399) ("Flat Fee"), for the listing of their property through the MLS Service. Payment is due upfront upon execution of the Listing Agreement.

Payment Terms and Services

Payment Method. You authorize our third-party payment processor(s) to store and charge your credit card as outlined in these Terms. You retain sole responsibility for the accuracy and completeness of your credit card information.

Updates. beycome or its third-party payment processor may, at its own discretion, and without advance notice, improve, enhance, modify, restrict, limit or add features to its Payment Services at any time.

Additional Terms. You may be required to accept additional terms and conditions in order to access or use certain Payment Services.

Third-party Processors. Certain third-party payment processors may charge you additional fees when processing payments in connection with the Payment Services. We are not responsible for any such fees.

Legal Compliance. You may not use the Payment Services except as authorized by United States law, the laws of the jurisdiction that is your country of residence, and any other applicable laws.

Refunds. A full refund is available if cancellation occurs before the listing is published on the MLS Service. For the Enhanced service, cancellation must also happen before promotional items are shipped and at least 48 hours before a scheduled photographer session.

  • If a property listing has an incomplete questionnaire for 30 days, it will be considered abandoned and will not be eligible for a refund.
  • If a property listing remains off the market for more than 30 consecutive or non-consecutive days, it will also be considered abandoned and not eligible for a refund.
  • All listings must comply with MLS Rules and Regulations. Non-compliance authorizes the Broker to cancel the listing without a refund.

General Restrictions

Except as otherwise permitted in these Terms, you shall not, and shall not purport to authorize, knowingly induce, or knowingly permit, any other person to, or attempt to:

  • (a) download, copy, publish or transmit any of the Website;
  • (b) modify, tamper with, adapt, translate, enhance or prepare derivative works or improvements of the Website, the Documentation, or any portions thereof;
  • (c) rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer or otherwise make available to any person, the Website or Documentation;
  • (d) reverse engineer, disassemble, decompile, decode, or decrypt the Website;
  • (e) intentionally bypass, breach, disable or defeat any security feature or Technological Safeguard used in connection with the Website;
  • (f) remove, alter, obscure, translate, combine, supplement or otherwise change any trademark or copyright marks, Documentation, or version numbers;
  • (g) access, use, or permit any other person to access or use the Website in any manner that violates these Terms or infringes any Intellectual Property Right of beycome;
  • (h) Process any User Data or Personal Information beyond what is permitted under these Terms;
  • (i) use, develop, distribute, or aid others in developing any software, website or service substantially functionally similar to, or competitive with, the Website.

Mutual Representations and Warranties

Subject to all terms and conditions of these Terms, each Party represents and warrants to the other Party that: (a) it is duly organized, validly existing and in good standing as a legal entity; (b) its entry into these Terms has been duly authorized; and (c) its undersigned representative has been duly authorized and has full legal capacity to execute these Terms.

Disclaimers of Representations and Warranties

YOU AGREE THAT THE DISCLAIMER OF WARRANTY PROVISIONS SET FORTH BELOW ARE REASONABLE AND REFLECT AN INFORMED, VOLUNTARY ALLOCATION OF THE RISKS BOTH KNOWN AND UNKNOWN. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. BEYCOME HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BEYCOME MAKES NO WARRANTY THAT: (I) THE SERVICE WILL MEET YOUR REQUIREMENTS; (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (IV) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

BEYCOME DOES NOT OWN, SELL, RESELL, PROVIDE, CONTROL, MANAGE, OFFER, DELIVER, OR SUPPLY ANY PROPERTIES. BEYCOME IS NOT AND DOES NOT BECOME A PARTY TO, OR OTHER PARTICIPANT IN, ANY CONTRACTUAL RELATIONSHIP BETWEEN YOU AND ANOTHER USER, AND BEYCOME IS NOT ACTING AS AN AGENT IN ANY CAPACITY FOR ANY USER, UNLESS THE PARTIES ENTER INTO A BUYER AGREEMENT OR LISTING AGREEMENT.

BEYCOME HAS NO CONTROL OVER AND DOES NOT GUARANTEE (I) THE EXISTENCE, QUALITY, SAFETY, SUITABILITY, OR LEGALITY OF ANY PROPERTIES; (II) THE TRUTH OR ACCURACY OF ANY PROPERTY OR USER DESCRIPTIONS, RATINGS, OR REVIEWS; OR (III) THE PERFORMANCE OR CONDUCT OF ANY USER.

Limitations of Liability

BEYCOME SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR: (I) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES; (II) THE COST OF PROCUREMENT OF SUBSTITUTE SERVICES; (III) AMOUNTS IN EXCESS OF THE GREATER OF (A) THE TOTAL FEES ACTUALLY PAID BY YOU TO BEYCOME IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) US $100.00, IN THE AGGREGATE FOR ALL CLAIMS; OR (IV) ANY MATTERS BEYOND BEYCOME'S REASONABLE CONTROL.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, BEYCOME'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Indemnification

You agree to indemnify, defend, and hold harmless beycome Corp. and its affiliated entities (including Beycome Brokerage Realty LLC, Beycome of Florida LLC, Beycome Brokerage Realty Inc., Beycome of Connecticut, Beycome Title of Florida LLC, and Beycome Mortgage LLC), and each of their respective officers, directors, agents, partners, and employees (collectively, "Indemnified Parties"), from and against any and all claims, demands, suits, proceedings, investigations, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • your use of, access to, or inability to use the Service or Website;
  • your Content or User Data, including any inaccuracy, misrepresentation, or infringement of third-party Intellectual Property Rights contained therein;
  • any dispute, claim, or transaction arising between you and another User, including but not limited to disputes between buyers and sellers relating to a property transaction facilitated through the Service;
  • your violation of any applicable law, regulation, or rule, including without limitation RESPA, TCPA, Fair Housing laws, MLS rules, or any state real estate licensing requirements;
  • your unauthorized use or redistribution of MLS or IDX data accessed through the Service;
  • your breach of any provision of these Terms, the Buyer Agreement, or the Listing Agreement;
  • any negligent or wrongful act or omission by you in connection with your use of the Service.

Notice and Control of Defense. beycome will notify you promptly of any claim subject to indemnification, provided that failure to provide timely notice will not relieve your indemnification obligations except to the extent you are materially prejudiced by such failure. beycome reserves the right, at its own expense, to assume exclusive control of the defense and settlement of any claim subject to indemnification. You agree to cooperate fully with beycome in the defense of any such claim and shall not settle any claim without beycome's prior written consent.

Beycome Indemnification of You. beycome agrees to indemnify and hold you harmless from any third-party claims arising directly from beycome's gross negligence or willful misconduct in the provision of the Service, subject to the limitations set forth in the Limitations of Liability section above.

Third Party Intellectual Property Rights

Website Content. You agree that all materials contained in or delivered via the Website is protected by copyrights, trademarks, service marks, trade secrets, or other intellectual property and other proprietary rights and laws. Except as expressly authorized by beycome, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works of any Website Content.

Third Party Infringement Claims. If a third party threatens or brings a claim that the Website, the Service, or the Documentation infringes any third party Intellectual Property Rights, beycome may, at its sole discretion, exercise commercially reasonable efforts to either remedy the infringement or terminate your use of the Service.

DMCA. If you believe in good faith that any Content made available in connection with the Service infringes your copyright, you (or your agent) may send us a notice requesting that the Content be removed or access to it blocked. Notices should be sent to:

Privacy Policy

All information provided by you or otherwise collected by beycome in connection with your access and use of the Website and Service is governed by beycome's Privacy Policy, which is hereby incorporated by reference into these Terms.

California Privacy Rights

California law permits Members who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for direct marketing purposes in the prior calendar year.

Effective on January 1, 2020, the California Consumer Privacy Act (CCPA) allows California residents, upon a verifiable consumer request, to request access to the specific pieces and categories of personal information that the business has collected about the consumer. California residents also have the right to submit a request for deletion of the information under certain circumstances.

Wire Fraud Warning

WIRE FRAUD IS THE #1 CYBERCRIME TARGETING REAL ESTATE TRANSACTIONS IN THE UNITED STATES. BEYCOME WILL NEVER SEND YOU WIRING INSTRUCTIONS VIA EMAIL, TEXT MESSAGE, OR ANY ELECTRONIC COMMUNICATION. DO NOT WIRE FUNDS BASED ON INSTRUCTIONS RECEIVED BY EMAIL OR TEXT WITHOUT INDEPENDENTLY VERIFYING THOSE INSTRUCTIONS BY CALLING YOUR ESCROW OFFICER, TITLE COMPANY, OR ATTORNEY AT A PHONE NUMBER YOU HAVE INDEPENDENTLY CONFIRMED.

How to protect yourself:

  • Always verify wiring instructions by calling your title company, closing attorney, or escrow officer directly using a phone number obtained independently — not from an email.
  • Be suspicious of any last-minute changes to wiring instructions, bank account numbers, or routing numbers.
  • Never click links in emails claiming to provide updated payment instructions.
  • Confirm receipt of wired funds with the receiving institution before closing.

Beycome's Liability Disclaimer. Affiliated Business Arrangement Disclosure (RESPA)

In accordance with Section 8(c)(4) of the Real Estate Settlement Procedures Act (RESPA), beycome is required to disclose that it has business relationships with affiliated entities that may provide settlement services in connection with your real estate transaction. These affiliated entities include:

  • Beycome Mortgage LLC — home loan and mortgage services
  • Beycome Title of Florida LLC — title insurance and closing services

Because of these relationships, referrals to any beycome-affiliated entity may provide a financial or other benefit to beycome Corp. An estimated charge or range of charges for the services of each affiliated entity will be provided to you upon request. This disclosure is provided in compliance with RESPA and does not constitute a guarantee of any particular rate or fee.

MLS and Listing Data Disclaimer

Listing information displayed on beycome.com may be sourced from various Multiple Listing Services (MLS) via IDX (Internet Data Exchange) feeds. This data is provided exclusively for consumers' personal, non-commercial use and may not be used for any purpose other than to identify prospective properties they may be interested in purchasing.

  • All listing information is deemed reliable but is not guaranteed to be accurate and should be independently verified.
  • Listing data is updated regularly but may not reflect the most current status of a property. beycome makes no representations regarding the availability, accuracy, or completeness of any listing.
  • Square footage, lot size, room counts, and property condition are estimates only and should be confirmed by a qualified inspector or appraiser before entering into any transaction.
  • IDX information is provided under license from the applicable MLS. Unauthorized use, reproduction, or redistribution of MLS data is strictly prohibited.

Miscellaneous

This segment should be read attentively as it may have a considerable impact on your legal rights.

  • Termination. If you breach any of these Terms, beycome will have the right to suspend or disable your Account or terminate these Terms, at its sole discretion and without prior notice to you.
  • Arbitration Dispute Resolution. Any controversy, claim, or dispute arising, directly or indirectly, out of these Terms or your use of the Service shall be determined by final, binding arbitration administered in English by JAMS. The venue for the Arbitration will be in Miami-Dade County, Florida.
  • Class Action Waiver / Venue. By accepting these terms and conditions, you consent to resolve any conflicts or claims with beycome on an individual basis and not as part of any class, consolidated or representative proceeding.
  • Jury Trial Waiver. YOU AND BEYCOME EACH HEREBY WAIVE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT EITHER MAY HAVE TO A TRIAL BY JURY.
  • Notices. Notices to you may be made via either e-mail or regular mail to the address in beycome's records.
  • Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Florida.
  • Injunctive Relief. beycome will have the right to seek and obtain injunctive relief in court for any violation of these Terms.
  • Prevailing Party Attorneys' Fees. In the event of any Arbitration or legal proceeding, the prevailing party shall be entitled to an award of their reasonable attorneys' fees and costs.
  • Non-Discrimination Policy. beycome is committed to an inclusive marketplace built on a foundation of trust, safety, and respect, without regard to race, color, religion, national origin, ancestry, disability, sex, gender identity, sexual orientation, or marital status.
  • Entire Agreement. These Terms constitute the entire agreement between you and beycome and govern your use of the Service, superseding any prior agreements, proposals, discussions, or communications between you and beycome on the subject matter hereof.
  • Waiver. The failure or delay of beycome to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Time to File Claim. Any claim or cause of action arising out of or related to use of the Service or these Terms must be filed within two (2) years after such claim or cause of action arose or be forever barred.
  • Agreement to Be Bound and Survival. Your agreement to be bound by these Terms commences with your accessing or using the Service and will continue until your right to access and use the Service is either canceled or terminated.
  • Force Majeure. Beycome shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, labor disputes, government actions, internet or telecommunications outages, or any other event outside beycome's reasonable control. In such circumstances, beycome's obligations will be suspended for the duration of the force majeure event.
